Abstract (EN)
Even though it is established to create a permanent unity of life, marriages end for various reasons. One of these reasons is divorce. Although it is possible for our law to terminate marriage through divorce, it is not as easy as in our old law. Because divorce necessarily requires a judge's decision, and the judge can make the divorce decision only in the presence of certain reasons. Reasons for divorce are stipulated in the Turkish Civil Code. These reasons can be considered in two main groups as general and special reasons. Both general and special reasons for divorce are seperately classified as the relative and absolute reasons for divorce, depending on the presence of the judge's authority to examine whether the conjugal union becomes unbearable. In this classification, as general reasons for divorce, shaken of conjugal union from the basis is among the relative reasons, and consensual divorce and failure to re-establish of common life are among the absolute reasons. As special reasons for divorce, adultery, caste to life, hardly bad and degrading behavior and abandonment are among the absolute reasons, and humiliating crime, living without dignity and mental illness are among the relative reasons.
