Abstract (EN)
At a period when knowledge provided authority for who has a say on it, intellectual property issue is one of the most important agenda items of popular culture and economy, and it has a strategic meaning both individually and socially. Intellectual property represents privileges on intellectual products that result from a mental activity. This issue, which has led to multi-faceted discussions, has become a subject that should determine the attitude of Muslim societies in the modern world and various proposals have been made regarding the framework of Islamic law. In this study, by analyzing the Turkish, English and Arabic literature on intellectual property in contemporary Islamic law, it has been analyzed which concepts the subject is dealt with, in what framework and by answering which questions. In this context, the historical course of the current accumulation is interpreted from a critical and holistic point of view. It is aimed to examine what kind of jurisprudence activity is carried out and the point reached in regards to a current fiqh issue in Islamic law without any judgement on the subject.
