Abstract (EN)
This study, which tackles the criminal law of jahiliyya and effect on Islamic criminal law, composed of introduction, general ewaluation and conclusion parts, coupled with three parts. In the introduction part, of the study; the subject, purpose, scope, importance, and limitations of the research are tackled. In the first part, which deals with the definition of the word jahiliyya and jahiliyya period; the regions of peninsula coupled with the man that is the core of the law and societys etnical and social structures are tackled. The formation of period's law, its nature and its historicial journey are tackled in detailed in the second part that is about the factors which affected the jahiliyya period to be formed, criteria of the pointed period's law hardships occurreel during implementation and pointed period's code of criminal procedure. The dispositions on crime and punishment are discussed in detail under the relative titles in the third part which deals definition of crime notion in the period, its elements and the sorts of the crime. In the general ewaluation part, the effect between these two legal systems that are examined profoundly under the relative titles is gathered in sums. In the conclusion part of the study, a general ewaluation that is relative to the detections we reached is made.
