Abstract (EN)
The crime of causing unrequited checks related to checks is regulated in article 5 of Check Law No. 5941. The legislator has based its history on the check written on the check fort he occurrance of this crime. Accordingly, it is sufficient for the offense to be kept in the check account within the legal submission periods to be calculated according to tha date of check written on the check. This issue is important fort he checks which are arrenged as dated dates which have become an indispensable tool of commercial life. In this study, information about the crime of giving a non-refundable transaction related to the check given. In the light of current debates and judicial decisions, elements of crime, its formation, reasons for compliance with law and other issues are discussed. In addition, there have been problems with whether this offense can be considered as an infringement of an obligation arising out of the contract and in the context of an economic offense.
