Framework contracts

A framework contract is a legal instrument that enables the parties to agree on the principles to which their individual contractual relationship(s) will be subject. Although frequently encountered in practice, the scarcity of works comprehensively examining this concept in Turkish legal literature and the resulting unanswered questions in doctrine have necessitated an examination of the concept of the framework agreement within the context of the Law of Obligations. The study consists of three sections. The first section will examine the "Concept and Legal Nature of Framework Agreements". The second section will address the "Establishment and Content of Framework Agreements", and finally, the third and last section will evaluate the "Relationship between Framework Agreements and Individual Agreements and the Consequences of this Relationship in terms of the Applicable Rules". Throughout the study, the fundamental principles of the Law of Obligations will be taken as a guide, but contrary to the approaches accepted in doctrine, assumptions that take into account the unique characteristics of the concept of a framework agreement will be presented.
