Abstract (EN)
Via articles 24 and 25 of the Law No. 7188 on the Amendment of the Criminal Procedure Code and Some Codes, the abrogated article 251 of the Criminal Procedure Law No. 5271 was re-arranged, and the simplified procedure was included in our legal system as an alternative dispute resolution method. The simple trial procedure, which started to be implemented in criminal proceedings as of 01.01.2020, is projected as an alternative dispute resolution method to classical criminal procedure. The simplified procedure is a special type of procedural tool that, under certain conditions, finds application in crimes that require a judicial fine and/or imprisonment up to two years and its application is at the discretion of the court judge. In cases where the simple trial procedure is applied and the defendant is sentenced, a reduction of one quarter is applied from the final sentence imposed on the defendant. In our study, the purpose of regulation of the simplified procedure, the conditions of its implementation and its relations with similar institutions are discussed. By making an evaluation in terms of comparative law, the simple trial procedure was examined within the scope of the right to a fair trial.
