Abstract (EN)
In this study, retrail in criminal procedure law, which is a legal way in criminal procedure law, was examined using the provisions of the Former Criminal Procedure Procedure Law No. 1412, judicial decisions and different opinions in the doctrine, especially the Criminal Procedure Law No. 5271. From the place in the legal remedy of retrail, it is explained the necessity of the path of this law, the form of application, under what conditions retrail can be applied.
