Abstract (EN)
In this study titled "Barriers to Performance of the Carrier under the CMR Convention", the liability of carrier, which is the basis of the law of carriage, is examined in terms of the barriers to performance of the carrier. In this study, it is aimed to explain in detail the obligations of the carrier, the scope of these obligations and circumstantes that constitute an barrier to performance. The rules to be applied when a barrier to performance arises have been investigated. In the first part, the obligations of the carrier, the scope of application of the CMR Convention and the applicaple law are explained. In the second part, the carrier's barriers to performance are analzyed. The CMR mostly contains articles on loss, damage and delay. However, in this study, other barriers to performance of the carrier other than loss, damage and delay are also included.
