Abstract (EN)
In his book Phenomenology of Spirit, Hegel puts forward the dialectical identity of We, which is I, and I, which is We, as the ultimate goal that self-consciousness aims to reach. This is the establishment of the unity of self-consciousness itself in the other. First, consciousness's experience of the world, and then self-consciousness' experience of history and society, is a movement that tries to achieve this identity. However, in Principles of the Philosophy of Right, the person takes a different action in the world: making a part of the world his own and making this part his private property. Therefore, the first action in which the legal person begins to realize himself in the world is the action in which he acquires private property. Private property remains a central theme throughout the rest of Principles of the Philosophy of Right. Ultimately, this concept enters into a reciprocal relationship with moments such as bourgeois civil society and the state themselves. However, it is not possible to say that the dialectic of We as I and I as We in Phenomenology is compatible with the state moment; in the state moment, no identity is established, there is difference. There is no identity between the general interests of the state and the private interests of the individual. There is no identity between right and duty. These differences persist; the state exists only to manage these differences rationally. Therefore, in the Principles of Philosophy of Right, the social and logical identity of We, which is I, and I, which is We, is not achieved. The reason for this appears in the very first moments of the Principles of Philosophy of Right, namely the private property moment. The fact that the legal person's first relationship with the world is an act of acquiring property will bring about a series of alienation relationships. This shows that Hegel, in the Principles of the Philosophy of Right, actually breaks away from his method in the Phenomenology. If the methodology in Phenomenology had been applied, different conclusions would have been reached in Principles of Philosophy of Right. First of all, the state moment should be considered as the middle term, not the last term; that is, the term in which the difference arises. The final moment should have been society itself; not a bourgeois civil society, but a society in which the identity of We, who is I, and I, who is We, is established. Dans son livre Phénoménologie de l'esprit, Hegel met en avant l'identité dialectique du Nous, qui est Je, et du Je, qui est Nous, comme le but ultime que vise la conscience de soi. C'est l'établissement de l'unité de la conscience de soi elle-même chez l'autre. Premièrement, l'expérience du monde par la conscience, puis l'expérience de l'histoire et de la société par la conscience de soi, sont un mouvement qui tente d'atteindre cette identité. Cependant, dans Principes de la philosophie du droit, l'homme accomplit une action différente dans le monde : s'approprier une partie du monde et faire de cette partie sa propriété privée. Par conséquent, la première action par laquelle la personne morale commence à se réaliser dans le monde est l'action par laquelle elle acquiert la propriété privée. La propriété privée reste un thème central dans le reste des Principes de la philosophie du droit. En fin de compte, ce concept entre dans une relation réciproque avec des acteurs tels que la société civile bourgeoise et l'État lui-même. Cependant, il n'est pas possible de dire que la dialectique du Nous comme Je et du Je comme Nous en Phénoménologie soit compatible avec le moment étatique ; dans le moment étatique, aucune identité ne s'établit, il y a encore une différence. Il n'y a pas d'identité entre les intérêts généraux de l'État et les intérêts privés de l'individu. Il n'y a pas d'identité entre le droit et le devoir. Ces différences persistent ; l'État n'existe que pour gérer rationnellement ces différences. Par conséquent, dans les Principes de philosophie du droit, l'identité sociale et logique du Nous, qui est Je, et du Je, qui est Nous, n'est pas réalisée. La raison en apparaît dès les premiers moments des Principes de philosophie du droit, à savoir le moment de la propriété privée. Le fait que la première relation de la personne morale avec le monde soit un acte d'acquisition de propriété entraînera une série de relations d'aliénation. Cela montre que Hegel, dans les Principes de la philosophie du droit, rompt en fait avec sa méthode dans la Phénoménologie. Si la méthodologie de la Phénoménologie avait été appliquée, des conclusions différentes auraient été atteintes dans les Principes de la philosophie du droit. Tout d'abord, le moment étatique doit être considéré comme le moyen terme et non comme le dernier terme ; c'est-à-dire le terme dans lequel la différence surgit. Le dernier moment aurait dû être la société elle-même ; non pas une société civile bourgeoise, mais une société dans laquelle s'établit l'identité du Nous, qui est Je, et de Je, qui est Nous.
