Özet (EN)

The COVID-19 pandemic has had a significantnegativeeffect on manypurwievsincludingtheindividualandsociety, such as health, economyandpolitics. A significantpart of thesaideffectsstillcontinuesandtheseeffectskeepuptodatebychanginganddeveloping. Vaccinesdevelopedforthetreatment of manydiseases since thebeginning of the 19th centuryhaveplayed an essential role in eliminatingthenegativeeffects of diseases. Inthiscontext, manycountries, in particularforsomediseases, havemade it mandatorytoapplyvaccinestostrugglingwiththesediseases. Countriesmakevaccinationapplicationsmandatorybyconsideringmanydifferentcriteriasuch as thetype of disease, theage of thepersonto be vaccinatedortheprofession of thepersonto be vaccinated. Compulsoryadministration of thevaccine is carriedoutthroughmethodssuch as therestriction of thefundamentalrightsandfreedoms of thosewhoare not vaccinated, ortheapplication of judicialandadministrativesanctionssuch as fines. Inthisstudy, themandatoryapplicability of vaccinesdeveloped in thecontext of the COVID-19 pandemicwill be discussedbyexamininginternational legal regulations, internationalcourtdecisions, regulations in ourdomesticlawandcourtdecisions, World MedicalAssociation (WMA) texts, TurkishMedicalAssociation (TBB) texts, World HealthOrganization (WHO) textsandscientificpublications in thehealthlawliterature. It is thoughtthatwiththisstudy, whichaimstodeterminethelegality of themandatoryapplication of COVID-19 pandemicvaccines on individuals, willcontributetothesolution of legal problemsencountered in thestrugglingwiththe COVID-19 pandemic.
