Limiting the fundamental rights and freedom by using presi̇dential decrees

With the influence of our society and the changing world, political policies have rapidly changed. As a result of the constitutional arrangements, serious changes have been made in Turkey's management system. The most important regulations are the amendments brought by the law No 6771 and dated January 21, 2017. For this reason, with the abolition of the statutory decrees issued in the normal period and in the abnormal period, Presidential decrees gained importance and were the subject of our study on how to restrict fundamental rights and freedoms. In the first part of my thesis, fundamental rights and freedoms are conceptually important and historically important from the past to the present. Then, taking into consideration the legal framework of 1982 constitution, it was examined how the fundamental rights and freedoms were classified and secured. In the second part, the differences and similarities of the Presidential decrees issued by the president and of the other regulations and other regulatory procedures were discussed in the light of how the duties, powers and procedures of the president were arranged and the factors of the Presidential decrees issued during the normal periods and in the state of emergency periods. In the third part, the Presidential decrees and how fundamental rights and freedoms are limited in the normal and state of emergency periods, are examined in terms of the compliance of these restrictions with the Constitution and other conditions with the law.
