Responsibility of the carrier for domestic load transportation by railway

In the scope of this study, the concept of transport and the activity of transportation are described in general matters to first present the readers a general knowledge. Besides, information is outlined on railway transportation and explanation is given on its history and development. Given in Chapter 2 of the study is information on the transport agreement. The specification of the law particularly bears significance in this context while applying to the agreements for domestic transport via railways which is the subject here to study. The law to be applied in agreements for domestic railway transport is determined to be the Regulation on Transport Work of the Rumeli Railway which began to be executed in the Ottoman era, hence the study progresses in the direction of this ordinance. In our opinion, due to the ordinance being obsolete and the railway transport being underrated in general, no relatively extensive academic study is determined which has been previously written in this field. Described in Chapter 3 is the responsibility of the transporter in the domestic transport via railways. Both the said ordinance and the rules of the Turkish Commercial Code are considered in this subject and the transporter's responsibility born out of loss, damage and delay are analysed. For the conclusion, considering the insufficiency of regulations in the law to be applied to the agreements for the domestic transport via railways against the contemporary activities of transportation and the requirements of the modern era, our study is concluded with our solutions and opinions oriented at the necessity of a new regulation or the fact that it must be subject to the current rules of the Turkish Commercial Code.
