Abstract (EN)
States frequently use sea mines to gain superiority over each other and defeat their enemies in wars at sea. The first and only international convention on the use of sea mines is the Hague-8 Convention on Automatic Submarine Contact Mines dated 18.10.1907. In addition to this treaty, although the San Remo Manual dated 1994 contains regulations on sea mines, it is not an international treaty, but a book of recommendations. Legal problems and abuse of rights may occur as a result of the use of sea mines in maritime jurisdictions and on the high seas. In particular, the Text of the Articles on State Responsibility for Acts Contrary to International Law issued by the International Law Commission in 2001 regulates the responsibility of states for acts contrary to international law and the consequences of such responsibility. Although this Text has not gained the character of an international treaty, the regulations herein are a systematic arrangement of the general rules that can be considered as customary rules. This Text is so important in order to inhibit abuse of rights, material and moral losses that may occur especially when states engage in armed conflicts with each other. Comprehensive international effort is required to prevent the use of sea mines in abuse of the rules of international law, Like all other unjust acts in international law. In this study, the conditions of use of sea mines and, responsibilities of state for using mine, and the consequences of their use in violation of international law are explained.
