Abstract (EN)

In this study, the relevant sect scholars' provisions of seafood in literature of Islamic law were examined with their proofs. The lack of an independent source of seafood in the Islamic law resources today when the fisheries sector has reached a gigantic size reveals the necessity of presenting the provisions of Islamic law as a study. In this study, it is aimed to put forward the provisions of seafood given in the classical sources and to include the perspectives of these provisions. In the first part, the subject of halal and haram in foods, and basic criteria for determining halal and haram are presented. In the second part, the concept of sea fishing is examined within the scope of the judgment of seafood, and the subjects such as hunting, authorization, using as food, buying and selling and using as jewelry are presented. In the third part, classical and modern period fatwas related to seafood are given and evaluations are made about these fatwas. As a result of the research, it is seen that the different provisions given by the sect scholars are originated from the perspectives of the sects on the subject of haram and halal and from the methods used while interpreting them.
