Legal responsibilities of the ones who take part in the stage of load, stowage, unload, delivery of container transportation by sea

The idea of carrying the shipment by gathering them was born in 1801 for the first time.With the evolution and development of this idea in time, the shipments have begun to be carried by standard repositories called containers. The invention of containers have accelerated the marine transportation and especially the development of shipping trade day by day.With the common use of container as a transporter, the labouring of shipping trade has been varied, the valid documents have been changed and the present legal regulations started to be insufficient to the hostilities appearing in this field.Thus, some law draft projects oriented to change and reform have been started to regulate also in our country as well as the rest of the world. Actually; even in the general preamble of the Draft Turkish Commercial Code, one of the essential technical reasons that caused the change of law is the use of container as a transporter.Therefore in this study we analyzed the legal responsibilites of the ones who were authorized for the container transportation in the affreightment contract phase, in three different sections in the light of present judicial regulations, doctrinal views and judicial decisions.In the first section of our study is focused on the function of container, its history, its types, its structure and its legal quality, the reasons for container shipping, the clean bill of lading in container transportation, combined transport agreement and finally the benefits and hazards of container transportation.In the second section instead, it is focused on the container transportation systems, the acceptance that creates the commission of affreightment contract, shipping, storing, stevedore and the important traits of commission phase in terms of container transportation.In the last section of our study, we analyzed the legal responsibilities of the labors working in the storing, stevedore and comission phases.
