The right to self-determination which constitutes a substantial point in theory and implementation of Public Law, Political Sciences and International Relations, has an ambiguous and complicated structure. In this study, the problematic structure of this right has been tried to put in to an analitic frame by taking into consideration the scientific and humanitarian realities with passing the different opinions in local and foreign literature through the filter of a legal perspective. The issue of the right to self-determination is examined with all specified aspects setting forth the negative and positive sides and submitted the reader's discretion in company with these informations and interpretations. This study that entitled "The Right to Self-Determination within the Context of State and Human Rights" consists of three main chapters. The first and second chapters form the basis of the subject, the third chapter rises upon this basis and aims at making the study distinctive. The first chapter named "The Notion and History of Self-Determination", examines the meaning of self-determination notion thoroughly and includes its history considering the chronological order and scale. The second section which is examining the "The Legal Scope and Types of The Right to Self-Determination" under this title, dwelling on the international documents that enabling the progress, transformation and application of the right to self-determination and the types of the right called "the right to internal self-determination, "the right to external self-determination" and "the right to economic self-determination. "The Examination of The Right to Self-Determination in Consideration of State and Human Rights" is the third and the last chapter which constitutes the specific part of the study. In this chapter, the relation between the right to self-determination and "state" is examined by referring other international rights and principles. In addition, this chapter reveals the important place of the right to self-determination, which takes place in third-generation of human rights, in Human Rights Law and human rights ideal.
