Abstract (EN)

In the settlement of disputes arising from the appointment and promotion of civil servants, administrative jurisdictions inspect the compliance of the unlawful procedure with the law in terms of authority, form, subject, reason and purpose. In order to determine the legality of administrative procedures related to appointment and promotion, administrative jurisdictions act in accordance with certain criteria. An administrative proceeding must comply with the principles of merit and equality as well as the needs of the public interest and service in order to be lawful. In this context, the main purpose of this study is to identify the conflicts arising from the promotion and promotion of civil servants and to interpret these disputes in the light of the case law resulting from judicial review. In the first and second parts of the study, the legal quality of the civil servant and the difference between the public officials and the rights and responsibilities of the civil servants, the principles related to their appointment and promotion are discussed. In the third part of the study, the purpose and necessity of judicial supervision are emphasized and the characteristics of administrative judiciary are stressed. Finally, the most conflicting issues arising from the appointment and promotion of civil servants have been examined within the framework of administrative jurisprudence and scientific opinions.
