الاختيارات الفقهية لأبي الخطاب الكَلْوَذاني( 510ه) من خلال كتاب الإنصاف( الطهارة والصَّلاة أنموذجاً )

Jurisprudence(Fiqh) is one of the most important sciences that a student of must learn, to worship GOD correctly, and that's one of the most important reasons that prompted the researcher to choose this subject, as well as the desire to acquaint researchers with comparative jurisprudence or Hanbali jurisprudence with the choices of Abi Al-Khattab in matters of purity and prayer, grouped in one chapter. The researcher followed the inductive approach in tracking the choices of Abi Al-Khattab in the books of Purity and Prayer, then the analytical approach in mentioning the evidence of sayings in the matter, then the comparative approach in comparing his choices with other sayings in the doctrine, and weighting between them by following some methods of contemporaries. The most important findings of the researcher are: The issues studied in this research has reached 52 issues, where it was studied according to a scientific method by mentioning the title of the issue، then presenting the sayings in it، including the choice of Abi Al-Khattab. Then he mentioned the evidence for each of them and concluded with weighting among the sayings mentioned in the matter. Imam Aba Al-Khattab agreed with the Hanbali jurisprudence with a percentage of 36.54%, while he disagreed with it by 63.46%, this indicates his intellectual independence and his distance from sectarian stagnation. Through the research, the accuracy of Abi Al-Khattab appeared in delving into the details of the jurisprudential branches, which proves his mastery in jurisprudence, as well as the care of the Hanbalis in his jurisprudential choices. There is hardly an issue in which a choice is made by Abu al-Khattab without his choice being cited in it, even if it was contrary to the most correct opinion in the school of Jurisprudence. At the last the study recommended studying other chapters in jurisprudence, which this research did not study, as well as in transactions, family provisions, hudud, felonies, and others.
