Abstract (EN)

In this study, in which gold trading transactions made through electronic payment instruments are evaluated in terms of Islamic law, the characteristics of the new payment instruments of the technology age, especially the shopping transaction processes, are examined and the compliance of the consumption contract (sarf akdi) with the basic rules has been tried to be determined. As far as we can determine, the absence of any study in the context of electronic payment instruments has been effective in the study of this subject. For this reason, it would be appropriate to examine each of the payment instruments separately to determine the compliance of the consumption contract (sarf akdi) with the basic rules. In the first part of this research, In the conceptual and theoretical framework, the basic rules of the consumption contract (sarf akdi), other contracts related to the consumption contract (sarf akdi) in terms of e-commerce, and the tools of electronic commerce, especially the payment instruments, are discussed. In the second part, each of the electronic payment instruments has been evaluated under its title. In the conclusion, it has been stated that the intellectual result of the consumption contracts (sarf akdi) made with each of them will be different since the functions and transaction processes of payment instruments with or without a card are different from each other.
