Environmental administration and law for industrial investments

II ABSTRACT In Turkey there has been a large number of laws and regulations legislated to serve the environmental protection since 1930's. With these laws and regulations the industries are taken under some responsibilities to prevent the environmental pollution. These legal obligations have been improved in the 80's and 90's with the new legal arrangements. The Environmental Law (legislated in 1983) led to several regulations regarding the environmental pollution. Air Quality Protection Regulation, Noise Control Regulation, Water Pollution Control Regulation, Solid Wastes Control Regulation, Environmental Impact Assessment Regulation, Hazardous Chemicals Regulation, Hazardous Wastes Control Regulation and Medical Wastes Control Regulation have followed to implement the Environmental Law. Depending on this legal framework, the technical environmental investments turned into legal obligations. But the richness of the laws and regulations and the institutions cause controversial situations. The industrial investments are highly affected by this dispute and the executive steps for the required procedures seem more complicated because of lack of information and wrong considerations. In the presented study, the Turkish Environmental Legislation has been reviewed to state the administrative obligations of industrial investments. With that purpose, the central, regional and local institutions that perform on environmental acts, their responsibilities and structures are examined and the prevailing laws & regulations are presented. The procedures of public plan permissions, environmental impact assessments, unhygienic installations licenses, air protective acts, water pollution prevention permissions, solid and hazardous waste disposal procedures have been reviewed and discussed.
