Abstract (EN)
The objective of this thesis is to determine the conditions and circumstances in which the contractor may rescind of an independent contractor agreement, which is a contract of instantaneous performance, and the consequences of said rescission.In the first chapter, contractor?s rescission of the agreement based on hiring party?s default of payment is discussed in accordance with the general provisions of law of obligations and independent contractor agreements.In the second chapter, contractor?s rescission of the agreement based on hiring party?s failure to receive the subject matter of the agreement or inability to compensate the contractor and the rise of various reasons that hinder performance of the debt are examined.In the third chapter, contractor?s rescission of the agreement based on unexpected circumstances affecting agreements in which a lump-sum payment is required is discussed in accordance with the provisions regarding independent contractor agreements.In the last chapter, contractor?s invoking of the right to rescind by way of or outside litigation is examined. Furthermore, consequences of the rescission right are analyzed in detail.
