Discussions around the effective cause ('illa) of ribā in the context of Aṣnāf al-Sittah hadith

The thesis of "Discussions around the effective cause ('ılla) of ribā in the context of aṣnāf al-sittah hadith" is divided into an introduction, two chapters and a conclusion. The first chapter is a study of the Hadith and the second is a jurisprudence study, the hadith study included two parts: an analysis of the text and an analysis of the chain of narrators of the hadith of aṣnāf al-sittah 'sanad and matn', in these two parts the 18 narrations of hadith were analyzed including an analysis of Hadith reference books that mentioned it, the narrators and the text. The second part included three chapters, a preliminary section, in which the meaning of the 'illa was addressed in language and Islamic terminology, its conditions and courses, in addition to the meaning of Riba in language and Islamic terminology and the wisdom of its prohibition. In the first chapter the question of the reason for riba was addressed , which is also divided into three parts, the first part is a discussion in which the ruling of Riba al-Fadl was explained by a study of a hadith that says "There is no Riba except in credit" with mentioning the difference between the ancient jurists in establishing the prohibition of riba al-Fadhl, in the second part the rulings of different jurisprudence schools (the four schools- Ibadi - Zaidism - other schools) were detailed about the reasoning of the Riba, in the third part the views of contemporaries were mentioned in Riba's error with the statement of opinion favorable in the matter, while the third chapter included issues of jurisprudence related to the riba's error, they are divided into six parts, the first examined the exchange of riba funds, the second is an examination of the standard of symmetry between two items, the third is an examination of the criteria of the quality unity and its differences, the forth is an examination of how to handover the money of riba, the fifth is a research of the repayment of debt in another currency, and the sixth is an examination of the provisions of riba in gold, silver and conventional money. In the end, several practical issues has been addressed , such as the issue of the price value of gold and silver, the issue of selling gold and silver jewelry with the same minerals or other items, in addition to the issue of depositing gold in banks, and the ruling on buying gold jewelry with credit cards and commercial papers, with an appendix mentioning the decision of the Islamic Jurisprudence Complex in Jeddah on gold trade and mentioning the legal standard no. (57) of the Accounting and Audit Authority Islamic financial institutions on gold. The conclusion included the most important results of this research
