Abstract (EN)

Turkish legal system adopted declaration of intention to be in dept. Therefore, in principle, contracts are binding their parties. Nevertheless, in some cases having right on a good could incur a dept without any intention and bind with the contract which is not signed. That is called realobligation. In other words, realobligation means that getting into a debt without any intention of it. Depts arising this way are connected to a real right or possession. The purpose of our work is to set forth Realobligations' different characteristics- include arising and termination- from real rights and other obligations that rise to relative rights within the scope of Law of Property principles, Civil Code, Turkish Code of Obligations and other concerned legislation.
