Franchising agreement

Franchising agreement is an anonymous contract type that is increasing day by day and is not regulated by law. The franchising contract is a framework contract that creates a mutual debt relationship. This agreement authorizes the franchisor to exercise his or her trademark, business name, know-how, and intangible rights, such as the franchisee. It also authorizes to version the goods or services. It is under an obligation to support it continuously during the activity. The franchising system is a system in which the franchisee uses the intangible rights of the franchisor and acts according to the instructions given by the franchisor to make the version of the products or services and pay the contract price in return. Within the scope of the thesis, the history and definition of the franchising contract are included in the first part. In the second part, the legal quality, features, form, types and positive and negative aspects of the section are explained. In addition, the elements of the franchising contract and its comparison with other contracts are discussed. In the third section, the obligations of the parties, the termination of the franchising contract and the consequences of the termination in terms of the parties and individual contracts are explained. In the fourth section, it has been evaluated that the franchising agreement is within the scope of the mixed agreement, and the analysis of the Supreme Court case law is included.
