Abstract (EN)
With the European countries' achievement of Economic integration which was their main goal, political integration has been added to the European Union's agenda. agenda. Political integration has also been one of the determinants on the policies of freedom, security and justice that were purposefully constituted to protect outer borders. The borders that change with every enlargement process were met with concern over the fact that the difference between the member states' welfare level and the predicted increase in "irregular" migration movements towards the Union territories parallel to the ongoing conflicts in different regions of the world. With all these developments, the EU has accepted the importance of protecting the borders in an integrated way which resulted in the Union making attempts to create an operational structure. As a result of the initiative, Frontex, the agency responsible for the integrated management and security of the Union's land, air and sea borders, was established. With the increase in the number of immigration movements towards the Union territories, each modification made in the Frontex statute has expanded both the agency's mandate and its authority. The steps taken parallel to the intense migration movements towards European territory manifesting as a crisis throughout the Union in 2015 revealed the failure of the Union's common migration policy. The collapse of the Dublin System and the countries in the border regions taking the responsibility alone resulted in a series of tensions, and new policy proposals that externalized migration ended up being taken a step further. In this context, the adoption of methods such as pushback, mass deportation and sending asylum seekers to unsafe third countries by Frontex, which is one of the important components of the Union's strategy to externalize migration, resulted in a violation of responsibilities arising from international law. Although there is a lot of evidence that states the violation of their rescue responsibilities determined by international law, it is considered that Frontex is not facing any sanctions because of the confusion of authority over who will be held responsible in case of a violation of rights.
