Working and social security rights of foreigners under temporary protection

The aim of this study is to examine the temporary protection status and the employment and social security rights of foreigners who have temporary protection status in Turkish law. In the first part of our study, temporary protection status in international law has been examined. In this context, the definition of temporary protection, its elements, the principle of non-refoulement and the minimum treatment standard are discussed. After that, what the temporary protection status is in Turkish law, the definition of temporary protection, its scope in terms of person, the termination of temporary protection, the services provided to foreigners with temporary protection status and the permanent solutions in case of termination of temporary protection are examined. In the second part, the working rights of foreigners under temporary protection status and the necessary conditions, procedures and principles for using this right are explained. In the last part of our study, the social security right of foreigners and the social security right and insurance status of foreigners under temporary protection were evaluated in terms of both legislation and practice.
