Revenue sharing construction contract

The construction sector which is regarded as the leading sector of Turkish economy is progressing, changing and developing day by day. With the advancing technology, the aspects of the people form houses escalate and in addition to confined spaces, elements like social areas etc. appears as the essentials of the newly constructed buildings. In the revenue sharing construction contract, the parties appear as the land owner and the contractor. The contractor meets all the expenses of the project that he's going to generate and responsible of the marketing activities and the sales of the property. On the other hand the land owner is responsible of handing over his premises without any defect, to give all the necessary authorisation and to pay the agreed share to the contractor after the sales. Despite the fact that the examples in the practise occurs as mostly large-scale projects, there is no obstacle in applying the revenue shared construction contract, which is our thesis subject, in small and mid-scaled construction projects. As a matter of fact, the revenue sharing construction contract can be evaluated as more advantageous compared to other methods in accordance with the concrete case.In our thesis study, revenue sharing construction contract is evaluated in three parts. In the firs part, the description, advantages, differences between similar contracts, elements, varieties, legal characteristics, and the form of the contract has been evaluated. Within the content of the second part, the subject of the obligation of the parties regarding the revenue sharing construction contract has been studied, the obligations of the land owner and the contractor has been profoundly evaluated. Contractors obligation of generating the construction, marketing and sale of the project, duty of loyalty and care and defect liability subjects has been analyzed. In the third part of our study, the termination of the revenue sharing construction contract has been evaluated.
