Abstract (EN)

Because of the reason that breeding studies take a very long time, are very costly and doesn't achieve success completely at the targeted level, genetics continually oriented towards new searchings. Especially new developments in genetic engineering and gene technology provide an opportunity to perform breeding studies in a short time and more economic. By means of genetic engineering works developed in recent years, changes in genetic structures of organisms accomplishedly concluded. Genetically modified organism means living organism other than human obtained by gene transfer using modern biotechnological methods. It is stated that genetically modified organisms whose reproduction is uncontrollable and which has very harmful effects on health and environment, have serious potential dangers for humans. Alongside its potential dangers, modern biotechnology is considered to have a great potential for the well-being of mankind if it is developed and used with adequate security measures. For this reason, it is necessary to take conscious biosecurity measures on modern biotechnology, to implement the necessary legal regulations and to establish the necessary control systems for the monitoring of these legal regulations. In this thesis, the legal responsibility arising from GMO and its products, which is regulated in article 14 of the Biosafety Law No. 5977, has been examined and it is aimed to contribute to the future studies and practice with the explanations which is made about the controversial points.
