Özet (EN)

This study aims to examine contemporary problems of democracy from the perspective of legal philosophy in a systematic manner. Although democracy is most simply defined as a form of government in which power belongs to the people, it has been the subject of numerous theoretical and practical debates throughout history and in the present day. The research categorizes the fundamental principles and current issues of democracy under the headings "Fundamental Problems Between the State and the Citizen," "The Problem of the Applicability of Democracy," and "The Problem of Controlling Power in Democracy." The discussion ranges from Ronald Dworkin's questions on judicial independence to contemporary topics such as euthanasia and the regulation of social media. The study adopts the methods and techniques of analytical philosophy, employing a descriptive and critical style supported by conceptual and linguistic analyses. Historical background analyses are provided to explore both the origins of the problems and the consistency of proposed solutions. The aim is to reveal the strengths and weaknesses of the presumed ideal democratic system, develop solutions to existing problems, and contribute critically to the understanding of democracy.
