Abstract (EN)
With the realization that the fossil fuels used from the industrial revolution to the present day are harmful to the environment, and the fact that these fuels will inevitably run out, renewable resources gained in importance. Solar energy, provided the appropriate means are employed, became a considerable alternative that is not harmful to the environment and whose cost is being reduced day by day thanks to technological developments. Turkish administrative law provides a detailed basis for the generation of electricity using solar energy. According to this legal framework, it is necessary to take out a license and a pre-license in order to make this production. There are requirements to be met by legal entities wishing to take these out. The aim of these requirements is to prevent the transgression of those elements of the public interest that are protected by other laws. These requirements, such as acquiring the right of ownership or use of the land where the production complex is to be set up, precision about the permits of town and building plans, and making decisions in the context of Environmental Impact Assessment, indicate the procedures relating to different public interests. It is the administration that will establish the balance between public interests during the licensing process. In the present work, we first analysed the fundamental legal sources that regulate the case of using solar energy in the production of electricity and considered the administrative authorities that deal with this subject, and then the legal quality of the license. Next, the process of pre-licensing and licensing was explained in detail, in the context of conflicting public interests.
