Abstract (EN)

The bankruptcy postponement, which was introduced in 2003, was repealed in July 2018. Instead, amendments have been made to the İİK in order to make the concordat operational. Concordat, which means "Contractual Bankruptcy", is an institution where the processes carried out by the companies or individuals whose financial situation has deteriorated are carried out in order to reach an agreement with creditors in good faith and subject to court approval in order to pay the debts by taking into account the rights of the parties. It is understood that the enterprises belonging to the construction sector are in the first place in the concordat request. 1/3 of the relevant concordat requests are in the Marmara Region. With the study, the southern Marmara region, Bursa, Balıkesir, Çanakkale, Yalova province) requested the construction companies about the Concordat; scale, scope, income-expenditure states, the information is gathered, the demand factors that play a role in the formation of processes and detailed data about the perceptions of the business after the declaration of the Concordat were collected. from Dec 2018 to 2022; In the Southern Marmara provinces, the number of construction companies that have received temporary acceptance is 79. Of these, 44 were reached and 34 companies, which correspond to 43.04% proportionally, answered the survey. The commissioners, officials of the companies and the sector professionals who are in charge of the process are the participants of the survey and the survey was conducted face-to-face. The questionnaire consists of 5 sections and a total of 45 questions, 1 of which is open-ended. The internal consistency coefficient of the obtained data is α = 0.714 and high significance. It was concluded that more than 70% of companies completed the concordat positively, but the attitude of stakeholders, especially banks, towards the process is generally negative, and the partners of enterprises negatively affect each other economically. In addition, it was understood that the absence of a civil engineer commissioner competent in sectoral functioning in the delegation disrupted the process, the lack of public receivables subject to the concordat forced firms financially, state incentives could not be used and resources could not be created due to the inability to participate in public tenders. As a result of the moderate attitude to be shown to concordat companies, improvement in implementation, the formation of delegations with the activity processes of companies and other arrangements, it will be possible to ensure the success of projects. It is thought that economic sustainability can be realized and negative situations such as employment and tax loss can be prevented if the recommendations obtained as a result of the findings covering the processes of companies before and after the concordat request are followed.
