Abstract (EN)
Similar to the development and change in societies, the change in human needs and trade relations leads to change or emergence of rules that keep society alive. After creating the state, protection of assets under the government's assurance is a requirement of being a state. In doing so, as the state punishes unjust action it protects the rights and interests of the individuals through compensation. Moreover, by declaring the law, the state warns individuals that unjust actions constitute crime and wants them to be more careful in their behaviors. The crime of breach of trust is the type of crime for which the sentiments of trust and possessions as well as the property rights of persons are protected by the state by law. In this thesis we addressed the form of regulation of the crime of breach of trust, the elements of the crime and the protected legal benefit. In this context, in the conclusion section, we have tried to address controversial issues and issues that we think is missing. The thesis consists of three parts. In the first chapter, the concept of abuse of trust, the place of the crime in the old and new criminal law, the subject of the crime, the legal benefit protected by the crime, the perpetrator of the crime, the criminal elements, special appearance forms. In the second part, the cases of the criminal nature are examined under separate headings. in order to be able to better understand and distinguish the crime together with the similar crimes in terms of quality, the differences have been examined under different headings and tried to be explained. In the third chapter, the provisions of the prosecution were examined. Finally, our criticisms and suggestions are presented in the conclusion.
