Abstract (EN)

Order list in sequestration is regulated in Enforcement and Bankruptcy Code Articles 140-142. The order list in sequestration, which plays an important role for the practice, is regularised when the amount obtained from the sale is not sufficient to meet the receivables of all creditors. Although the articles related to the order list seem quite understandable at first, they have been the subject of many Turkish Supreme Court decisions. The study area of the thesis is two remedies that can be applied against the order list in sequestration. These two remedies are count against the order list and action for demurral against the order list. The aim of the thesis is to present the solution proposals for the practice by revealing the features and differences of both remedies. In the first part of the thesis, after the concept of the order list was introduced, in the second section, the count against the order list was processed. In the third and last part, the action for demurral against the order list is explained and solution suggestions are given in the conclusion part.
