Abstract (EN)

The first hundred articles of the Mecelle are known as general principles within the Islamic legal heritage. In this context, rules that are generally valid for all issues are called "kavâid", while those that are valid for a single issue are called "davâbıt". Everyone who is educated in Islamic law and conducts postgraduate studies in this field is aware of the importance of general principles in being able to look at fiqh holistically. General principles serve as a guide for those working in the field of Islamic law in many matters. However, studies in this field generally remain superficial, and are often limited to memorizing these principles. Many people who memorize general principles are unaware of the evidence from which these principles originate, with a few exceptions. At this point, in our studies on the interpretation of the Qur'an in the language of the religion, Elmalılı's approach to kavâid and davâbıt has attracted our attention. For he establishes interesting connections between seemingly unrelated principles and verses, revealing the evidence from which the principles originated.
