Abstract (EN)

Protection of exertion, which constitutes the basis of unfair competition with the new Turkish Commercial Code; It has been taken under the new provision of "unauthorized use of the work products of others". In order to ensure the lawful continuity of competition in a healthy environment, it is important to protect the "work products" that are put forward by the efforts and experience of the competitors and that determine the difference between them and their competitors. The desire of rivals to beat each other; makes it important to protect the work products brought together by years of experience of market participants and intellectual effort and exertion. Otherwise, the right to free competition is violated unlawfully and parasitic competition occurs. It is important to protect the exertion of the participants in order to avoid parasitic competition. As a new provision in Turkish Law; With the provision of TTK 55/1-c, it is aimed to prevent parasitic competition and "Protection of Exertion". In this study, the relationship of the act of "unauthorized use of the work products of others" with provisions other than unfair competition provisions will be discussed and then the specially regulated TCC 55/1-c provision will be examined.
