Abstract (EN)

In the Turkish Trade Law no 6102, the provisions related to unfair competition arranged in detail to cover all unfair competition situations regardless of their commercial qualification. This study‟s main matter in hand consist "Civil Cases in Unfair Competition" which take an important place in trade life. The aim of this thesis is to help to practitioners via informing them about the differences and the consequences between possible civil cases related to unfair competition. In this vein, detailed explanations have been made about the litigation and sue processes of detection, prevention, restitution, material and non-pecuniary damages developed out of the unfair competition. The study consists of three main sections. Firstly, the information about general principles of unfair competition has been given. Then, it has been tried to concrete the unfair competition situations which are very similar to or complement to each other. In the final section of the thesis, our main topic "civil cases in unfair competition" have been examined in terms of their basis and procedures. In this context, with giving place to temporary legal protections which are important for civil cases in unfair competition, explanations about the processes that might be applied before the litigation have been made. The thesis was finalized by making explanations about the mediation case condition in trade cases which is also going to be applied for civil cases opened due to unfair competition from 01.01.2019.
