Abstract (EN)

The concept of "child" evokes such concepts as ignorance, lack of protection, innocence, neediness in man. These shortcomings of the child should be corrected by fully qualified adults with love, compassion and compassion by protecting, educating and preparing for life. Islamic law has attached great importance to the child and the rights of the child and has protected their rights in all matters. So much so that he gave custody of young children to caring and compassionate people who are connected to neseb and religion on the grounds that they are unable to take care of themselves and cannot meet their needs in person. Guardianship is a sharia authority given to the father because they are compassionate and compassionate people, as well as having a more accurate opinion of the child. The scope of this authority is determined as savings that are only in the best interests of the child. In Islamic Law, all children are secured both personally and financially by the institution of "custody" or "guardianship". A guardian or guardian is assigned to protect all children, whether orphans, orphans, finds (lakits) or their parents are divorced, protect their property. In order for these parents or guardians to be authorized to save money related to the child, the necessary qualifications have been determined meticulously by Islamic lawyers. In terms of the savings of parents or guardians who have the necessary qualifications for both the person and the property of the child, the child's interests have been taken into account and the limits have been determined.
