Abstract (EN)

In Islamic law, ijtihad, which is practiced by generating ideas by using language and procedural rules on open-to-interpretation texts, has led to the emergence of different ideas and sects due to the diversity of the secondary evidence used as well as the depth of the perspectives of the mujtahid scholars. This study, which focuses on the differences of opinion between the Hanafi and Shafi'i sects, consists of an introduction and three chapters. The first chapter discusses the formation, basic foundations, and general characteristics of the Hanafi and Shafi'i sects. In the second part, the main reasons for disagreement between the two madhhabs and their reflections on furū'-i fiqh are discussed through examples as much as possible. In the third part, the opinions attributed to Imam Shafi'i and the Shafi'i madhhab in 19 places in Mullah Hüsrev's Durar al-hukkām —from sacrifice to marriage—were examined by comparing them with Shafi'i sources. It was found that these attributions were correct in 12 places, there were details in the Shafi'i madhhab in 6 areas, and in 1 place the opinion attributed to the Shafi'i madhhab was erroneous.
