Abstract (EN)

Everyone has the right to benefit from health services at the time of need for treatment. The patient chooses freely the treatment method to be applied and the physician who will apply the treatment. In terms of physician, the physicians have freedom of treatment. The constitution protects the right of physicians to practice their profession freely as with every profession. Physicians may use the right to refuse the patient within the scope of the freedom of treatment. Within the scope of the freedom of treatment, physician determines the treatment method to be applied to the patient according to the professional judgment without any pressure. However, since the right to treatment of the patient is a fundamental right, physicians have a narrower area of freedom compared to other professions. Physicians can use the right of refusal only if there are professional or personal reasons. It is also not possible for the physician to reject the patient during emergencies and during the performance of the official or human duty. Similarly, the physician's freedom to choose the treatment method is subject to some limitations. In this study, the conditions, limits and results of the physician's freedom of treatment were evaluated together with the right to treatment of the patient.
