The responsibility of air carrier from the lost of luggage, damage of luggage or delay of luggage

In this study, the responsibilities of the carrier arise from the agreement between the passenger and the carrier and the sanctions on him caused by the lost, destroyed or lately delivered luggage of passenger were interpreted.The article have three main sections.In the first one the regulation of air transport agreement according to the Turkish and International law were explained under the topic of introduction.In second section the definition, sides, establihment, form ,inclusion and legal meaning of such an agreement were defined in details from the points of the transporter and the passenger as well as their rights and responsibilities, under the topic of transporting agreement between the company and passenger.In the third and the last section which was titled as the responsibilities of air transporter for the luggages of passenger, the definition of luggage was made and its kinds were defined. Then the legal meaning and conditions of the responsibilities of transporter were interpreted. In the discussion of the conditions for the responsibilities of carrier, firstly the conditions appeared by the damage of luggage during transport and then the conditions occured by the delay in transportation of the luggage were examined seperately. Additionally, the inclusion of transportrer?s responsibilities was discussed in details from two different aspects. In the first one the limited responsibility system, the limits suggested in this system and those who could utilize this system were defined; and in second part of this approach, unlimited responsibility system of exceptional conditions and the ways of unlimited responsibility were discussed. Furthermore getting clear of responsibility, the way of this clearance and legality of the clearance were examined.Finally the responsilities of air carrier were summarized in the result section of the thesis.
