Abstract (EN)
The physician, should act with care while performing his profession. Violation of this obligation may result in damaging damages. In the first part of the thesis, the elements of medical intervention and treatment are explained one by one and the types of medical intervention are evaluated. Medical intervention, one of the most important personality values of life, body integrity and health violates. The necessary conditions for the compliance of this violation with the law are also discussed in this section. In the second part, the types of medical defects and the occurrence of medical defects and the types of medical errors in general were examined. In the same section, the concept of complication is explained and in the case of complications, the conditions under which the physician can be freed from responsibility and in which cases the physician can be held accountable are discussed. In the third part, the legal nature of the relationship between the physician and the patient and the conditions of treatment (power of attorney) or medical works contract, the situations in which the physician's intervention is regarded as unreasonable and tort and the cases are considered. In the event that the physician works in a private hospital, a full admission and admission hospital admission contract wase valuated for the purpose of determining the responsibility of the private hospital operator and the physician, who has responsibility in publichospital. Lastly, theissues of indemnity, proof and time limitation arising due to application error after medical intervention were discussed.
