Abstract (EN)

Larceny (or aka theft) is defined as shortly taking of another person's movable property for the purpose of benefiting from it without the consent of the owner. The fact that the larceny is committed about the goods left in a public place by means of being locked or the goods protected within building or built on is regulated as 'aggravated major case' by the law-makers considering the reasons such as the protected legal benefit, the negative psychological effect of the action on the victim and the sense of security. Larceny is not a recent type of crime. In this study, it is aimed to provide information about the historical evolution of this crime, which is as ancient as history of humanity. After a general overview provided on the concept of larceny, the major case of this crime which is the subject of our study is focused and both Turkish Penal Code No. 765 and the regulations in Turkish Penal Code No. 5237 have been included and evaluations have been made in the light of the decisions of the Supreme Court. In the study, the issues within the framework of the Supreme Court applications are examined together with the different opinions in the doctrine. The first part of the study includes the definition of larceny, protected legal benefit, comparison with similar crimes, and historical development while the second part focuses on the elements of crime and special cases and the third part comprehensively deals with the major case, which is the subject of our study.
