Abstract (EN)

This topic studies the importance of refugees and their legitimate rights in international law and Islamic law. Do refugees get their rights in accordance with international law, conventions and statements alleged by international human rights organizations and Islamic law? Alternatively, not! This research aims to clarify all the laws, teachings, and provisions provided for in international law and Islamic law and to take responsibility by both of them with regard to this important humanitarian issue. As well as not granted the legitimate rights of refugees, according to the claimed by the international conventions and declarations, because of the lack of interest by several countries and international regulations for the rights and refugee issues, and also sometimes they turn a blind eye and conspire on their rights to save their own private benefit. However, the reality of dealing with the issue of refugees today has changed with the averse of States to receive refugees by setting up many physical, administrative and legal barriers to obstructing the arrival of refugees or forcing them to return to their country of origin even if the conditions are insecure and unstable. In order to arrive at the objective of this research, I have clarified the concept of right and asylum, the reasons for asylum and the conditions of asylum as well as the rights and duties stipulated in international law and Islamic law, and protecting the rights of refugees internationally and mechanisms for the protection of refugees and clarifying the legal status of refugees in international law and Islamic law. And determine the legal status of the asylum seeker, clarify the protection of the rights of refugees in the light of international agreements, as well as principles governing the right of asylum in international law and Islamic jurisprudence, and clarify the types of asylum in international law and Islamic jurisprudence. And the end of asylum in international law and Islamic jurisprudence, as well as the similarities and differences in refugee rights between international law and Islamic jurisprudence, and the questions that end with asylum in "law and jurisprudence" in some detail.
