Traffic accidents in terms of legal and criminal liability and a new model suggestion for the determination of traffic accidents

Traffic rules, which emerged at the end of long experience and experiments to ensure road safety and order, have been among the most violated rules nearly in all countries. And, any violated traffic rules most of the time lead traffic accidents.As the real causes of traffic accidents are not determined in our country as it should be, real solutions for this problem have not been produced. For this reason, traffic accidents have turned into an unrecovered, steady, and dangerous problem in our country that leads to loss of lives and property damage more than war, earthquake, and epidemics.Considering all these negative issues, in this study, traffic accidents that especially lead to loss of lives and property damage and their legal and criminal liability consequences have been discussed in a multidimensional approach. It was also acknowledged that how important the determination of traffic accidents in an accurate, scientific, and objective way can be for the determination of legal and criminal consequences of traffic accidents and analysis of traffic accidents in a future time in an accurate and scientific way based on traffic accidents determination reports. In additon to that, a new model that aims to bring real solution to this problem is suggested by addressing the real causes of traffic accidents. In this proposed model, instead of existing traffic accident teams that mostly include two officers; the necessity of preparation `traffic accidents determination and analysis reports? by technologically equipped traffic accident teams, which include traffic police or/and gendarmerie (trained for traffic accident investigation) who is expert on traffic accidents, experienced engineers (machine/automotive engineers, construction engineers, and traffic and/or transportation engineers), and finally crime scene investigation experts, is highlighted. Consistent with this model, a new ?Traffic Accident Report? has been designed for the use of these new teams that can be used to figure out all factors.Key Words : Traffic Accident, Legal and Criminal Liability, TrafficAccident Determination, Traffic Accident Report.
