The reasons and conflicts betwen malikî and şafiî sects in the book Bidâyetü'l Müctehid by Ibn-i Rusd - spesific to Kitabu'n Nikâh-

İbn-ı Ruşd, who lived in the 5th century of hijri calendas in Andalusia and was subject of Malikî sect, wrote the book Bidayetu'l- Muctehid and Nihayetu'l-Muktesid which is a comparison of sects. This book is an importont source in which is present many imams' views with their profs alongside with Şafiî, Hanefî, Malikî, Hanbelî and Zahirî sects. Our thesis includes the conflicts and reasans of Şafiî and Malikî sects on Kitabu'n-Nikâh part of it. There have come about many canflicting vicws on the subject of matrimony. These different views, have occured on consignation reasons. The components, validity conditions, financial outcomes of the treaty. In fact all of these so-called topics haven't been subject to conflict, sometimes there has been alliance on a subject on the whole but disaccord on the details. For example, both sects agree on the necessity of the bridewealth neverthless disgree on its details. There are many reasons for the disagrements betwen Malikî and Şafiî sects. Different opinions betwen the two sects', depend upon the behaviours and attitudes of madina residents, diffenent opproaches to the reasons of forbidance, considering diffent profs, the prof of mürsel hadis, mesalihi mursele, the differentiation of profs and the commentation of nass. Some of the reasons mentioned above are related to the style, İstinba, while others are realated to the abilities of the sect imams.
