Abstract (EN)

The survival of the capitalism system depends on the continuity of the production-consumption cycle. The system in order not to break the cycle; By using the means such as mass media, advertising, fashion, shopping malls, the concept of need has changed and many artificial needs have emerged. People tend to consume more in order to satisfy their new needs, hedonic, symbolic and conspicuous consumption types that can be evaluated in the category of extravagance have been normalized and consumer culture has become dominant in societies. This culture has led to the formation of a consumer society and that extravagance has become an adjective of societies. Extravagant individuals, defined as "safīh" in Islamic Law, are placed under restraint in order to prevent the destruction of their property with tabdhīr and the harm that they, their dependents and the society may suffer due to their extravagance. Like discriminating minor, their purely beneficial transactions are valid, transactions to their detriment are void and their transactions with the possibility of benefit and harm depend on the permission of their parents. In today's Turkish Civil Code, likewise, wasteful people are restricted. Considering the aims of the sanctions imposed on the safīh and the devastating consequences of extravagance, it can be said that similar sanctions can be applied to "safīh societies", provided that the jurisdiction of the law is respected with punctual investigations and the rights of individuals are not violated.
