Abstract (EN)

The rapid advancement of technology has changed the social structure and administrative systems. With this change, regulatory and supervisoryinstitutions have emerged to meet the need for regulation in sensitive areas of social life. The Competition Authority, which is tasked with protecting the competitive market structure, has relatively more experience among such institutions in Turkey. The most recently established regulatory and supervisory institution is the Insurance and Private Pension Regulation and Supervision Agency.Insurance is one of the sensitive areas of social life.In this field, which requires technical knowledge and expertise, the administration has an important duty in order not to mislead consumers. While fulfilling this duty, the public interest should be taken into account and the competitive market structure should be protected. This balance is only possible with a study that requires special expertise. There is no doubt that the work of the administration will also be subject to judicial review. The fact that the judicial review of the administration and the appropriateness audit cannot be carried out makes the work of the administration even more important. Since people will want to focus on the area they trust, it is extremely important that a system based on trust, such as insurance, is transparent. The share that people allocate for insurance serves to increase the level of welfare by turning into investments through funds. Since a transparent insurance sector will give confidence to people, it creates an environment that encourages people to insure. On the other hand, insurance companies established with large capitals tend to compete in a free market environment. This competition can sometimes lead them to form Associations or make agreements at the expense of the consumer. These activities, which will occur to the detriment of the consumer, can be restrained by adopting a competitive culture and complying with competition rules. With the increase in competition sensitivity, anti-competitive behaviors can be prevented and at the same time an increase in welfare can be achieved.
