Abstract (EN)

As in all legal disputes, the resolution of disputes in which the administrative body is a party is carried out mainly by the judicial authorities. The fact that trial is long, costly and limited has made it essential to resort to alternative dispute resolution methods such as mediation. Mediation, which is one of the dispute resolution methods that does not constitute a real "alternative" to trial and aims to provide easier, cost-free and flexible solutions than trial, is a way that has been applied in dispute resolution in our country. There are no obstacles to the use of mediation as an alternative dispute resolution method in resolving disputes to which the administrative body is a party. However, it is important to determine which of these disputes are suitable for settlement through mediation and which are not. In this study, the issue of whether the mediation based on the observance of the principle of equality between the parties is an effective decourse, especially in terms of resolving administrative disputes, has been examined by including foreign country applications in this study.
