Abstract (EN)
The Administrative Monetary Fines have a significant place in the historical development of the criminal proceedings. As the day goes on, the areas of its application continue to increase. In this thesis; the Administrative Monetary Fines which can be encountered in almost every area was assessed within the scope of the Misdemeanor Law. In this scope; books, articles, laws, regulations and court decisions were used. In the first part of the course of administrative penalty and he described in detail the concepts of fault, they become defective in misdemeanor of conspiring with associates to eliminate and to inspection issues. The second chapter includes as of administrative penalty authority to the subject matter are described in detail. In addition, the administrative penalties will be referenced with the process of notification and collection describes the judicial way. In the last chapter is located in the Act No. 5326 and administrative fines enforcement court decisions are explored with misdemeanors examples applied. The workload of the judicial authorities has been reduced due to the administrative sanctions are being imposed without the need for any judicial proceedings. However, in practice, important problems can be encountered while determining the number of administrative fines and achieving to prevent the consequences of the related misdemeanor. For this reason, administrative fines should be adapted to today's economic conditions to be an effective deterrent.
