Abstract (EN)

Labor receivables are the most basic right of an employee subject to an employment contract. As a matter of fact, the labor benefits that the worker deserves are the only source of livelihood for himself and his dependents. Therefore, the employment contract of the employee, depending on the craftsmanship it deserves receivables, profit and employees for the purpose of obtaining employee, according to the economic factors with the employer in a stronger position to sense other people and protection against the principle of social justice and is regarded as a requirement of the state. The need to protect labor receivables also manifests itself seriously if the employer becomes economically weak due to various circumstances and subsequently enters into bankruptcy process. As a matter of fact, in the process of bankruptcy, the inability to obtain labor receivables compared to other receivables can lead to serious rights losses and even misery for workers. In our study, has been mentioned bankruptcy processes, labor protection and guarantee receivables accepted in Turkish Law on the protection of privileged protection through international conventions and arrangements, systems and related Institution examined within the framework of the accepted systems protected labor of the receivables for the purpose of detection, the main labor receivables after the announcement of Turkish Law for the protection of labor claims in bankruptcy in the process of the system adopted in practice and regulations and these regulations are going to be experiencing in the face of delays.
